City Center Survey Sweepstakes

Your email address will never be shared, rented or sold to third parties. No purchase necessary. Void where prohibited. Entrants must be at least 18 years old at time of entry – one entry per person. All entries must be received by, January 31, 2012 at 11:59 P.M., Eastern Standard Time. Employees, agents and directors of Alvin Ailey Dance Foundation, Inc. and their affiliates, as well as immediate family of such persons are not eligible to enter or win. Odds of winning depend on the total number of eligible entries received. Winners will be selected in a random drawing no later than 2/28/13 from all eligible entries received and will receive notification by email within thirty (30) days of the drawing. Winners must respond to the notification email within thirty (30) days of receipt in order to receive their prize. If a potential winner fails to respond within the required time period, alternate entrants will be selected in his/her place at random.

To Enter:

To enter the City Center Ailey Enter to Win (the “Sweepstakes”) all entrants must complete the Alvin Ailey American Dance Theater 2012 City Center survey (the “Survey”).
Each individual is eligible to enter their information ONLY ONCE.

Entries by any other method other than as set forth above are void. Normal Internet access and usage charges imposed by your on-line service will apply for electronic entries.

Eligibility:

To be eligible for the Sweepstakes, the entrant must, at the time of entry (the “Entry”): be a natural person legally resident in the 50 United States (including the District of Columbia) and physically located and residing therein (excluding Guam, Puerto Rico, all other U.S. territories and possessions); and be 18 years of age or older. Only entrants who complete all required entry requirements in accordance with the specifications set forth in these Official Rules will be eligible to enter and receive the prize as described below.

Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who are currently employed by Alvin Ailey Dance Foundation, Inc. or who are enrolled in The Ailey School and/or the immediate family and household members of such individuals, are not eligible to enter the Sweepstakes. “Immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. “Household members” shall mean people who share the same residence at least three months a year.
 

Winner Selection and Notification:

One winner will be randomly chosen by February 28, 2013 from all entries received (the “Winner”). The Winner will be notified by email and have three (3) days to claim the PRIZE once contacted. For the name of the Winner, please send a SASE to Alvin Ailey American Dance Theater, Marketing Department, 405 W. 55th Street, New York, NY 10019.

Prize:

One (1) Prize Pack will be awarded per winner. The Prize Pack will include Ailey merchandise. The total approximate fair market value of the Prize is $100. The Prize Pack cannot be transferred by the Winner or redeemed for cash and is valid only for the item detailed above, with no substitution of prize by the winner.  If the Prize Pack is unclaimed with three (3) days after notification by email the Prize Pack will be forfeited and an alternate winner may be selected.

Conditions:

Ailey reserves the right to terminate the Sweepstakes or permanently disqualify from any promotion any person it believes has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Ailey, who may seek damages to the fullest extent permitted by law. Ailey reserves the right in its sole discretion to cancel or modify the Sweepstakes should any computer virus, malfunction, or other cause beyond its control corrupt the administration, security, or proper operation thereof. In the event of cancellation, the winner will be selected from all eligible, non-suspect entries received prior to the event requiring cancellation. Notice of cancellation will be posted at www.alvinailey.org.

The failure of Ailey to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Ailey (excepting compliance with applicable codes and regulations), or other force majeure event will not be considered a breach of these Official Rules.

Ailey assumes no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering in connection with the Sweepstakes. Ailey is not responsible for and is not liable for telephone, telecommunications, hardware or third party software malfunctions, failures, or difficulties of any kind; any failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software; any condition caused by events beyond the Ailey’s control that may cause the Sweepstakes to be disrupted, corrupted or terminated; any printing or typographical errors in any materials associated with the Sweepstakes; any incorrect or inaccurate entry information whether caused by you or any equipment or matter under the Ailey’s or the Website’s control; or any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure, misdirection or delay of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or on the alvinailey.com website, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation in or downloading or uploading any materials from the Sweepstakes.

Ailey does not make any representation, warranty or guarantee, express or implied, relating to the Sweepstakes. Entrant hereby agrees to indemnify and hold harmless Ailey and its respective affiliates, employees, officers, directors, and agents and any person or entity affiliated with the Sweepstakes from any claim, liability, injury, damage or other loss arising out of or related to Entrant’s participation in the Sweepstakes, including without limitation any materials submitted, any failure on your part to fully comply with these Official Rules, and any acceptance, use or misuse of any Prize.

DISPUTES: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF. THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
